Terms and Conditions

Before ordering  any product from our site, www.activeorthotics.co.uk, please read the terms and conditions detail on this page carefully, as these are the terms and conditions by which
we supply our products, and by which you enter into and agree to be bound by should you proceed to purchase any item from us. These terms and conditions and any document referred to within them constitute the whole agreement between us and replace any previous contract held between us.

If there is any point which you do not understand please contact us for clarification before proceeding with any purchase.


Ordering

Upon ordering you will be sent an automated confirmation e-mail to confirm that your order has been received.  A further e-mail will be sent to confirm dispatch, only at this point is the order deemed to be accepted. In a few cases some verification may be needed before the order can be accepted by ourselves. All orders are subject to our acceptance, which will be confirmed by ourselves via the use of a confirmation of dispatch e-mail.

 

Orders for products received before 2.30pm on Monday to Friday will be despatched on the same day, orders placed after 2.30pm Monday to Friday. All orders placed on a Saturday and Sunday, or Bank Holiday will be dispatched on the next working day.


If you require special delivery please contact us prior to ordering, so that we may assist in providing you with an accurate cost.


We endeavour to keep all items offered for sale in stock, but reserve the right to cancel your order if we have insufficient stock, in which case an e-mail notifying you will be sent, and a refund of all monies paid by you will be processed immediately.  We are un-able to pay any compensation to you for any disappointment suffered.


Orders for overseas shipment


At present we do not ship overseas.

Advice


We are unable to offer any medical advice as to the suitability of any of our products for your condition.  It is your responsibility to consult a medical or orthopaedic professional as to
the suitability of our products for your needs  before you place any order, and our acceptance
of your orders is on the basis that you have made all necessary enquiries to determine  that the Product ordered is suitable for your individual needs.


Price and payment

Prices quoted are inclusive of any applicable VAT and there are no additional charges for standard delivery. We reserve the right to change prices at any time, but such changes will not
affect orders in respect of which have already been placed. In the event that the price changes between an order being placed and the order accepted (dispatched), the lower price will always be honoured.



Cancellations and returns


All orders placed may be cancelled, at any point prior to the order being accepted by ourselves in the form of an e-mail confirming dispatch. After this point, items may be returned to us, in
the original un-used condition and packaging within 14 days from our shipment date. We are unable to bear the costs of returns for un-wanted goods, nor refund on goods that fail to arrive back with us, therefore we would always recommend you use a trackable service.

All products offered for sale, are deemed by ourselves to be of good quality, free from  manufacturing defect and to be fit for the purpose advertised. If you believe a new or used item to be faulty, or sub-standard, please contact us before returning the item.


All our insole products come with a 30 days guarantee, and all other products offered for sale include a 45 day guarantee. This warranty will be void if the item has been mis-treated, or been used in a different way to any guidelines provided, within the packaging or on our website.


This is in addition to your statutory rights.



Our liability


Our products are sold to you on the basis that you have sought professional orthotic advice as to the suitability of our products. Therefore we shall not be liable in any way for any loss or
damage that you suffer, or incur as a result of you ordering a product which is unsuitable for your condition, or where we custom make a product to a specification or prescription supplied by yourself.


Communication

Applicable laws require that some of the information or communications we send to you should be in writing. By using our website, you agree to accept e-mail communication, content posted on our site as the main form of communication between ourselves.  By accepting our terms and conditions you accept this electronic means of communication, and you agree that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement .


This condition does not affect your statutory rights.



All notices given by you to us must be given to us by writing to  or electronically via e-mail at Active orthotics, 29 Carters lane, Kiln Farm, Milton keynes, Buckinghamshire, MK11 3HL or via Email at: info@activeorthotics.co.uk. All postal communications and e-mails will deemed to be received within one working day in the case of letters and e-mail received on a standard working day, Monday to Friday, and on the following  working day in the case of e-mails  post and received after 5pm on Friday, a Saturday, Sunday or Bank Holiday. Should a response be needed we will endeavour to respond within 24 hours of this time frame, however this cannot be guaranteed. In proving the service of any notice by post we advice it be sent recorded delivery, in the case of an e-mail it is sufficient  for you to be able to demonstrate that such and e-mail was sent to the specified e-mail address, in this instance info@activeorthotics.co.uk.


Privacy Policy


We are committed to protecting and respecting your privacy.

For the purpose of the Data Protection Act 1998 (the 'Act'), the data controller is Active Orthotics Ltd, 29 Carters Lane, Kiln Farm, Milton Keynes, Buckinghamshire, MK11 3HL

We may collect the following information about you:

Information, that you provide by filling in forms on our Site. This includes information provided at the time of registering to use our site, subscribing to our service, posting material or
requesting further services.


If you contact us, we may keep a record of that correspondence for our due diligence, but under no circumstances will contact you for marketing purposes unless specifically requested by
yourself.


We will maintain details of transactions you carry out through our Site, and of the fulfilment of your orders.


We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.


All information you provide to us is stored on our secure servers, and we do not have access to, or keep financial information.
 Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Should anyone order goods in your name all responsibility and compliance with this policy will be passed over to yourself.


We will not use the information which you give us to contact you, about anything other than your order, unless you have opted in to be kept informed about our future offers and promotions. We will not contact you for future marketing purposes unless you have
specifically requested to be kept informed.

We never share any data with third parties.


Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail.


Severability

If any of these terms and Conditions or any requirements of this Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, the term, condition or requirement will be removed from the contract, in which case the remaining terms and conditions will form the complete basis of the contract between ourselves, and will continue to be valid by law.


The contract between us is governed by English law. Any dispute or claim arising out of or in connection with this contract , shall be subject to the non-exclusive authority of the courts of England and Wales.
